• AI outbound call handling
• Appointment scheduling
• Call recording
• Call transcription
• Call summaries
• Lead management and CRM functionality
• Human escalation and transfer features
• Business workflow automation

You may use the Services only if you are capable of entering into a legally binding agreement.

While there is no specific minimum age requirement, GainWise AI is intended for responsible individuals and businesses capable of managing commercial communications and complying with applicable laws.

You are responsible for:

• All activities conducted through your account.
• Maintaining the security of your login credentials.
• Ensuring information provided to GainWise AI is accurate.
• Compliance with all laws and regulations applicable to your use of the Services.
• Obtaining any legally required consent before recording, monitoring, or transcribing calls.

You remain solely responsible for the content of calls, messages, customer interactions, and business communications conducted through the platform.

Customers using outbound calling features are solely responsible for compliance with applicable telemarketing, calling, messaging, privacy, consent, and consumer protection laws.

This includes but is not limited to:

• Do Not Call regulations
• Consent requirements
• Telemarketing laws
• Consumer protection requirements
• Call recording laws

GainWise AI does not verify the legality of your outbound campaigns.

Customers are responsible for ensuring they have the legal right to contact recipients.

Outbound calls may utilize phone numbers provided, owned, or controlled by the customer.

Customers represent and warrant that they possess all rights and permissions necessary to use such phone numbers.

The Services may record, transcribe, summarize, analyze, and process communications.

By using the Services, you authorize such processing and represent that you have obtained any legally required permissions or consents from relevant parties.

Call recordings, transcripts, summaries, and related records may be retained by GainWise AI for operational, auditing, compliance, security, service improvement, recordkeeping, and personalization purposes.

Artificial intelligence systems may occasionally generate inaccurate, incomplete, misleading, or unexpected outputs.

Customers must independently verify important information before relying upon it.

GainWise AI does not guarantee the accuracy, completeness, or suitability of AI-generated outputs.

Certain interactions may involve transfer to human agents or authorized personnel.

Information associated with such interactions may be accessible to authorized personnel for support, quality assurance, auditing, operational, or compliance purposes.

You may not use the Services to:

• Conduct fraudulent activities
• Impersonate others
• Harass, threaten, or abuse individuals
• Send spam communications
• Violate privacy laws
• Engage in illegal telemarketing
• Distribute malware
• Circumvent platform security measures
• Conduct unlawful activities

GainWise AI may suspend or terminate accounts engaged in prohibited activities.

Fees for the Services are determined by GainWise AI.

All payments are non-refundable unless otherwise required by law or expressly agreed in writing.

GainWise AI reserves the right to:

• Modify pricing
• Introduce new pricing plans
• Change billing structures
• Modify included features
• Introduce usage-based charges

Pricing changes may become effective upon notice through the website, platform, email, or other reasonable communication channels.

Continued use of the Services constitutes acceptance of updated pricing.

While GainWise AI strives to provide reliable service, uninterrupted availability is not guaranteed.

The Services may be unavailable due to:

• Maintenance
• Infrastructure failures
• Third-party service disruptions
• Network issues
• Security events

GainWise AI and its associated technology, software, branding, content, and intellectual property remain the exclusive property of GainWise AI.

These Terms do not transfer ownership of any intellectual property rights to customers.

Customers retain ownership of their business data.

You grant GainWise AI a limited license to store, process, analyze, transmit, and use such data solely for operating, improving, securing, supporting, and providing the Services.

GainWise AI is not a healthcare provider, emergency service provider, law enforcement agency, or medical advisor.

The Services must not be relied upon for emergency response, medical diagnosis, treatment decisions, or urgent situations.

GainWise AI may suspend or terminate access immediately if:

• These Terms are violated.
• The platform is used unlawfully.
• Security risks are identified.
• Abuse or misuse is detected.

The Services are provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, GainWise AI disclaims all warranties, whether express or implied.

To the maximum extent permitted by law, GainWise AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the Services.

GainWise AI may modify, improve, discontinue, replace, or remove any feature, functionality, integration, pricing model, workflow, or component of the Services at any time.

GainWise AI may update these Terms periodically.

Continued use of the Services following updates constitutes acceptance of the revised Terms.

These Terms shall be governed by and interpreted in accordance with the laws applicable to GainWise AI's operating jurisdiction.
